Participation Waver

This waiver sets out the terms and conditions under which You (as named on the Membership Application) agree to participate in classes and events (Classes) held by Sarah Jean Ewen ABN 66 285 827 165 (the Business), acknowledging and accepting the risks involved. Memberships are non transferrable.

1. Acceptance of Risk

   By completing this Membership Application, You understand and accept that participation in martial arts classes and events (Classes) contains inherent risk and that You participate at your own risk. You hereby release, indemnify and hold harmless the Business, its owners, officers, agents, volunteers and all fellow participants with respect to any and all injury, disability, death, loss or damage to a person or property whether arising from negligence or otherwise which may arise out of or in connection with your attendance and participation in Classes run by the Business. You expressly agree that this release is intended to be as broad and inclusive as permitted by the laws of Western Australia and that if a portion is held invalid that this portion shall be severable and the remainder shall stand.

   
   

2. Health and Safety

   You confirm that You are physically fit to take part in classes and have not been advised otherwise by a medical practitioner. If You have any existing medical conditions, it is your responsibility to seek medical clearance prior to commencing training.

   In the event of Your pregnancy, You agree to refrain from participation in Classes for the duration of the pregnancy unless otherwise agreed with the Business. The Business reserves the right to decline permission to allow You to participate whilst pregnant. The Business accepts no liability in relation to any pregnancy and You agree to indemnify, release and hold harmless the Business from any and all claims arising from or in connection to Your participation in Classes whilst pregnant whether knowingly or unknowingly.

   
   

3. Agreement to Follow Directions

   You agree to follow all instructions, policies and procedures of the Business as amended in relation to membership and Classes, and understand that failure to do so may lead to the termination of Your Membership without further notice.

4. Payments and Refunds

   Payments for Classes are due in advance and no refunds can be offered for a failure to attend. Refunds due to exceptional circumstances may be offered at the absolute discretion of the Business.

   
   

5. Termination of Membership

   You understand that the Business retains the right to end Your membership at any time. You understand that You will be required to discontinue Classes if You are deemed to be a danger to Yourself or others or act contrary to the Ethos, Policies or Code of Conduct of the Business.

   
   

6. Provision of Classes

   The Business reserves the right to cease provision of classes at any time. In the event that classes cease permanently, any remaining membership fees will be refunded pro-rata.

You understand and acknowledge that this waiver forms a condition of Membership and that the Business relies upon this waiver when extending Membership to You. The waiver survives the end of the Membership and continues to operate where membership is terminated by either party.

Where the member is a minor under the age of 18 years, the parent or guardian who signs this waiver agrees to the Participation Waiver and the contained release of behalf of and in relation to the Member.
